By downloading, installing, or using the Treo: Scale for Grams application (“Treo”, the “App”, “we”, “us”, or “our”), you (“you” or “User”) agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.
Treo is a mobile application that uses artificial intelligence to provide weight estimates of objects based on photos you submit. The App analyzes images and returns estimated weights along with confidence scores.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices that you own or control, solely for your personal, non-commercial use.

Treo offers auto-renewable subscription plans that unlock additional features and unlimited weight estimations. Current plans and pricing are displayed within the App at the point of purchase.
If a free trial is offered, any unused portion of a free trial will be forfeited when you purchase a subscription, where applicable.
All purchases are processed through the Apple App Store or Google Play. Refund requests are handled in accordance with Apple’s and Google’s respective refund policies. We do not directly process refunds.
We may change subscription prices from time to time. Price changes will take effect at the start of the next subscription period following the date of the price change. You will be notified of any price change in advance and may cancel your subscription before the change takes effect.
You retain ownership of any images and content you submit to the App (“User Content”). By submitting User Content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the weight estimation service to you.
You represent and warrant that you have all necessary rights to the User Content you submit and that your submission does not violate the rights of any third party.
The App, including its design, code, graphics, logos, text, and trademarks (including the name “Treo”), is owned by BLACKSMITH and protected by intellectual property laws. Nothing in these Terms grants you any rights in our intellectual property except for the limited license described in Section 3.
The App uses third-party services including OpenAI for AI processing and Google Firebase for analytics and crash reporting. Your use of the App is also subject to the terms and privacy policies of these third-party providers.
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT WEIGHT ESTIMATES WILL BE ACCURATE. WEIGHT ESTIMATES ARE GENERATED BY AI AND ARE INHERENTLY APPROXIMATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKSMITH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO ANY DAMAGES RESULTING FROM RELIANCE ON WEIGHT ESTIMATES PROVIDED BY THE APP.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless BLACKSMITH, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the App.
We may suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms. You may stop using the App at any time by uninstalling it. Sections 6, 7, 10, 11, and 12 survive termination.
If you downloaded the App from the Apple App Store, the following additional terms apply:
If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service.
We may update these Terms from time to time. Material changes will be communicated through the App or by updating the effective date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of Latvia, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of Latvia, except where mandatory consumer protection laws of your country of residence apply.
